Tusa P.C. and Scott + Scott LLP announce the filing of a class action lawsuit against Apple Bank For Savings in the New York Supreme Court. The case was filed on behalf of an Apple Bank customer claiming that Apple Bank’s overdraft fee and check clearing practices are deceptive, contrary to contracts with its customers and results in charging interest rates above the highest rates approved by New York State. “This case attempts to bring Apple Bank into compliance with banking and consumer protection laws applicable to checking account customers,” said Joseph Tusa of Tusa P.C., co-counsel for the plaintiff. “It is unfortunate that Apple Bank charges its customers the largest Overdraft Fees in the state without obtaining prior customer approval,” added Joseph Guglielmo, a partner at Scott + Scott LLP who also represents the plaintiff and the proposed class.
