Scott+Scott, Attorneys at Law, announce that a settlement has been reached to settle the claims in In re Aetna UCR Litigation, MDL No. 2020, NO- 2107-CV-3541 pending in United States District Court for the District of New Jersey. Pursuant to the settlement agreement, Aetna will pay up to $120 million to reimburse Aetna plan members and their providers for qualifying, covered, out-of-network services. A copy of the Settlement can be viewed below.

The lawsuit and resulting Settlement arise out of claims that Aetna used databases licensed from Ingenix, Inc., a wholly-owned subsidiary of United Healthcare, to set usual, customary and reasonable ("UCR") rates for out-of-network services, that were inherently flawed and artificially reduced reimbursements to Aetna members and their out-of-network providers.  Scott+Scott filed the first action against both Aetna and Ingenix in 2008 on behalf Aetna members and was a member of the Executive Committee representing subscribers.  The complaint alleged that the conduct of Aetna and its co-conspirators constituted both per se and rule of reason violations of the antitrust laws and also violated plan member agreements under ERISA and state law. According to Joseph P. Guglielmo, partner at the firm, "We are very pleased that we have been able to obtain this significant settlement which corrects a long-standing practice of under-reimbursing members for the out-of-network services they have received.”
